All bookings between Languedoc Cycling ("we", "us") and the customer ("you") are made in accordance with the terms and conditions set out below.
A provisional booking on any holiday may be made by telephone or e-mail and will be held for 7 days if more than 8 weeks before the start of the holiday. On receipt of a completed, signed booking form and a deposit of 10% of the total holiday cost the booking will be confirmed in writing and an invoice issued for the holiday, together with a receipt for the deposit and the payment terms for the balance. If the booking is not possible the deposit will be returned. The balance must be received by us at least 8 weeks before the start of the holiday. Where a booking is made within 8 weeks of departure, the full amount of the holiday cost must accompany the completed booking form. We reserve the right to cancel the booking if payment is not made in accordance with these terms. Payment should be made using credit/debit card or by cheque payable to 'Languedoc Cycling Limited'. A 2% surcharge will be made on amounts paid by credit or debit card (except UK debit cards).
If you need to make changes to your booking after the booking has been confirmed, such as changing the date required, we will do our best to meet with your requirements if you inform us in writing. However, if the alterations requested are not possible, and if you do not wish to continue with your original booking, we reserve the right to apply the cancellation charges as set out in the Cancellations section below. Bookings may be transferred to another person if desired, and the new booking will be confirmed on receipt of a completed booking form. Changes leading to a reduction in the numbers of people taking part in the holiday (effectively a cancellation of part of the booking) will be treated in accordance with the Cancellations section below.
If you need to cancel a booking, or part of a booking, for whatever reason once it has been confirmed, cancellation will become effective upon receipt of written notification from you, and the following cancellation charges will be due:
More than 8 weeks before start of the holiday — deposit only.
Between 4 and 8 weeks before the start of the holiday — 33% of total holiday cost.
Between 2 and 4 weeks before the start of the holiday — 50% of total holiday cost.
Between 1 day and 2 weeks before departure date — 75% of total holiday cost.
If you cancel your holiday on or after the commencement date, 100% of the cost will be payable and no refund will be made.
In the case of part-cancellations, these charges will apply to the proportion of the total holiday cost attributable to the cancelled part.
If we need to make material changes to the content or terms of the holiday as published before the start of the holiday we will notify you as soon as is practicable. If you are not happy with the arrangements we have made, we will provide you with a full refund after receipt of cancellation letter from you.
If we have to cancel a booking we will offer an alternative date if possible. If this is not possible or acceptable to you we will refund in full any moneys already paid, as a full settlement. We will endeavour to notify you of any cancellation at least 5 weeks before the holiday start date; if notification takes place after this date we will pay an additional £15 per person in compensation for your inconvenience.
We reserve the right to cancel the booking or end your holiday, without any obligation to refund or make alternative arrangements, if your behaviour adversely affects others' enjoyment of the holiday. In such circumstances we would have no obligation to continue to provide services to you, and we will be under no liability for any costs incurred as a result.
You are the best person to judge your fitness or ability to take part in an activity-based holiday. If you are in any doubt, talk to your doctor before committing to taking part in any of these activities.
While we are happy to recommend routes that we have researched and enjoyed, we do not accept any responsibility whatsoever for the condition of the roads or tracks that you use. You must always ride responsibly with respect to both yourself and other road users. You must take into account riding conditions and ensure that you are always adequately prepared for the day's cycling.
You are solely responsible for the condition of your equipment, unless we provide it. We recommend that you wear a properly fitted cycle helmet.
We shall not be held liable for any damages caused by the total or partial failure to carry out the contract if such failure is:
Where we are found liable for damages in respect of our failure to carry out the contract, the maximum amount for which we will be liable is limited to the proportion of the total holiday cost for the individual concerned.
While we do not anticipate that you will be unhappy with our services, we understand that occasionally our customers might have cause to complain. Any complaints should be communicated to us as soon as they arise, so that we can deal with your concerns. If you are still unhappy after the holiday your complaint must be made in writing to us at the company address within 28 days of the end of your trip.
This contract is governed by English law.
